Action brought by plaintiffs-respondents, Vincent S. Dittman, and his wife, Beverly M. Dittman (hereinafter "plaintiffs")
against the defendants-appellants, Edward Nagel, and his wife, Susan Nagel (hereinafter "defendants"), to recover damages
for an alleged breach of an express warranty in a real estate sales contract. On March 22, 1965, the plaintiffs signed an offer to purchase the home of the defendants. The premises are located in the
town of Delafield, Wisconsin. Because the plaintiffs were worried about purchasing a home with a well and a septic tank system,
the following statement was stamped on the offer to purchase:
